LOADING OF SOFTWARE ONTO A COMPUTER INDICATES YOUR ACCEPTANCE OF THE FOLLOWING TERMS AND CONDITIONS: The Software (“NeuCom© Student”) is temporarily made available (not sold or given) to you for evaluation under the terms of this Agreement: the “Knowledge Engineering and Discovery Research Institute” (KEDRI) at “Auckland University of Technology” (AUT) retains all right and title to the Software and related documentation (and any copy thereof). RESTRICTIONS: Reproduction, disclosure, reverse engineering, disassembly, modification, attempting to access portions of the code for which you do not have a license, use for any purpose other than non-commercial evaluation, and/or distribution by any means of the Software are prohibited. Also, to clarify, you may not rent, lease, loan or resell the Software. The term "non-commercial," as used in this License, means: for academic or other scholarly research which (a) is not undertaken for profit, or (b) is not intended to produce works, services, or data for commercial use, or (c) is neither conducted, nor funded, by a person or an entity engaged in the commercial use, application or exploitation of works similar to the Software. TERMINATION: (a) The Agreement may be terminated at any time by destroying and disposing of the Software together with all copies and merged portions in any form. “KEDRI” must be advised of such action. (b) This Agreement will immediately terminate if you fail to comply with any term or condition of this Agreement. You agree upon termination to promptly destroy the Software together with all copies and merged portions in any form and notify “KEDRI” of such actions. WARRANTY DISCLAIMER: The Software is provided only for evaluation purposes on an “as is” basis. No warranties are given or implied, including the implied warranties of fitness for a particular purpose. LIMITATION OF LIABILITY: “KEDRI” will not be liable for any damages, including lost profits or data, or other incidental or consequential damages, arising out of the use or inability to use the Software of any data supplied therewith, even if “KEDRI” has been advised of the possibility of such damages arising.
